SC dismisses IGP Punjab’s petition filed against the LHC’s decision restoring police constable Muhammad Aslam
ISLAMABAD, Nov 6 (SABAH): The Supreme Court of Pakistan has dismissed application filed on behalf of Inspector General of Police Punjab Dr. Muhammad Usman Anwar against the Lahore High Court’s order restoring police constable Muhammad Aslam.
The petition was filed by Inspector General of Punjab Police and others against police constable Muhammad Aslam. Muhammad Aslam was removed from service on the alleged involvement in immoral activities with a woman. Three member bench headed by Chief Justice Qazi Faez Isa and comprising Justice Aminuddin Khan and Justice Athar Minallah heard thecase.
Additional Advocate General Punjab argued that the constable Muhammad Aslam was found involved in immoral activities with a woman at her home. The woman is addicted to such activities and on a tip off, the police raided. To this Chief Justice of Pakistan Justice Qazi Faez Isa remarked this could be expected from the Punjab Police. The woman says that constable is her husband, whether she is speaking truth or lieing. Chief justice said that the police constable won his case and his point of view in front of us.
He questioned do the Punjab police follow its employees that where they spent nigh, adding that whether police carryout such raids against their own officials? Chief justice said anyone is followed if he is a terrorist. Chief justice said that everyone says he is an innocent, adding that it is responsibility of the police to investigate the matter. Additional Advocate General Punjab argued that it was surfaced in the inquiry that the “Nikahnama” has been managed.
Justice Athar Minallah said that how police could raid someone’s home without warrants as it is committing unlawful activities. He further remarked does the Supreme Court endorse the unlawful activities of Punjab Police.
When Chief Justice asked the Additional Advocate General Punjab, he told the court an official standing behind him is SP Investigation Bawalnagar and second is DSP Investigation Bahwalnagar. To this, Chief Justice while taunting the SP, asked does crime rate in Bhawalnagar is zero who has come here for trivial matter while leaving Punjab province and his district of appointment. Chief justice said if SP Investigation had no other good work to do? Justice Qazi Faez Isa the woman is saying she is the wife of the constable and the police officers are saying she is not, adding that what is personal interest of these officers in the case, adding that it is so much important case that if the police officials had not appeared in court the walls of Pakistan would have shaken. On further asking, Additional Advocate General Punjab told that Bahawalnagar is about 700 kilometers from Islamabad.
Chief Justice further asked do the police officers have come here on their own expenditures or would draw TADA from the government. Additional Advocate General Punjab informed that the bench that only fuel expenditure will be given to the police officials. Upon this chief questioned whether it is official fuel or public fuel, the police officials appeared in court while passing 800 kilometers.
Additional Advocate General Punjab argued that he had stopped the police officials coming to court. He informed the court they had been directed to appear in court by court one of the Apex Court. To this, Chief Justice Qazi Faez Isa remarked that he has not issued such instructions and show him if he has issued such introductions. Chief Justice Qazi Faez Isa while rejecting the petition said that Additional Advocate General Punjab was not able to point out any illegality in the impugned order under Article 212(3) of the Constitution. The bench declined the request of leave to appeal and subsequently the petition was dismissed.
