IHC issues notices to federation, Commission of Inquiry on Enforced Disappearance and Ministry of Defence in Missing Person Case


 ISLAMABAD, Nov 16 (SABAH): Islamabad High Court (IHC) has issued notices to federation of Pakistan, Commission of Inquiry on Enforced Disappearance and Ministry of Defence in Missing Person Case.

 On Wednesday, the Islamabad High Court conducted hearing of the case of Habib Ur Rehman who has been missing since 2011. The case was put before Chief Justice Amir Farooq. The brother of Detenue Saad Ur Rehman and lawyers of defence of human rights including Imaan Hazir Mazari appeared as plaintiff.

 They informed the court that Habib Ur Rehman was allegedly abducted from CMH Sialkot, wherein the latter’s wife was in labour! This baby girls is now grown up and, sadly, has never even seen her father. Saad’s only hope for seeking justice rests with the Islamabad High Court. They also informed that the family has knocked every door to know about his whereabouts.

They approached the concerned police station, Lahore High Court, Commission of Inquiry and even the Supreme Court of Pakistan but to no avail.

Commission of Inquiry after 11 long years , on 30 August 2022 issued his production order wherein it had directed the Ministry of Defence to produce Habib Ur Rehman within a period of four weeks but three months have passed neither he is produced nor any action taken against the abductors.

Disheartened by the snail pace of the Commission, Defence of Human Rights filed a constitution petition in Islamabad High Court for redressal of the grievances and seeking disbandment of the toothless Commission altogether.

 The Chief Justice of the Islamabad High Court was pleased to admit Saad Ur Rehman’s writ petition against the Commission of Inquiry on Enforced Disappearances and issued notices to all the respondents.The court adjourned the hearing for two weeks.
