ICADRP & Int’l partners sign historic MOU in Kashgar, signaling a paradigm shift in Pak’s Dispute Resolution landscape & Global Dispute Resolution practices
KASHGAR, Nov 01 (SABAH): In a ground-breaking development for international dispute resolution, the International Centre for Appropriate Dispute Resolution and Prevention (ICADRP) has formed a transformative alliance with leading institutions in the field – the International Commercial Mediation Center for the Belt and Road (BNRMC), Beijing Retio Legal and Commercial Service Center for the Belt and Road Initiative, the Law Ascertainment Center (Guangzhou) for BRI (BNRLAC), and InteLaw GBA.
This landmark Memorandum of Understanding (MOU), signed on October 30, 2023, in Kashgar, China, not only reinforces Pakistan’s critical role in the Belt and Road Initiative (BRI) but also has the potential to transforms the nation’s dispute resolution landscape and offers potential implications for international dispute resolution practices.
Key Highlights of the MOU:
The MOU lays out a thorough framework for cooperation between the signatories, with an emphasis on advancing mediation and other forms of alternative dispute resolution in cross-border commercial transactions. In the areas of trade, investment, mediation, and alternative conflict resolution, it enables a smooth exchange of information. The MOU promotes cooperative efforts to advance the knowledge of arbitrators and mediators through training programs, research projects, and development projects. Furthermore, by offering essential facilities and an effective online system, the MOU facilitates the planning of mediations and encourages the participation of seasoned experts in each other’s panels. Moreover, the MOU provides ICADRP with the responsibility of overseeing cases referred or transferred by collaborating institutes for mediation and/or arbitration. ICADRP is entrusted with ensuring that these cases are managed promptly and in accordance with its arbitration and mediation rules, ensuring a fair and unbiased resolution process.
In terms of creating effective, amicable, and impartial dispute resolution mechanisms, this historic collaboration marks a monumental turning point. By strengthening Pakistan’s dispute resolution system, it has the potential to improve the nation’s standing in international trade and inspire confidence in both foreign and local investors and stakeholders. Moreover, this MOU has the ability to favorably influence international dispute resolution practices in general by utilizing the expertise of ICADRP and the collaborating reputable institutions.
