CJP Qazi Faez Isa orders police to not arrest anyone on mere allegations leveled in FIR until & unless it has incriminating material for arrest

ISLAMABAD, Nov 16 (SABAH):  Chief Justice of Pakistan Justice Qazi Faez Isa has ordered police to not arrest anyone on mere allegations leveled in FIR until and unless it has incriminating material for the arrest.

A three-member bench of the Apex Court headed by CJP Justice Qazi Faez Isa and comprising Justice Aminuddin Khan and Justice Athar Minallah conducted hearing on two separate petitions one bail before arrest petition filed by Muhammad Aqeel Shafique and second bail after arrest filed by Tahir Ishtiaq in murder case. In the petitions, state was made party through prosecutor general Punjab, Lahore. On behalf of petitioner first petitioner, Khan Rustam Khan appeared via video link from Lahore.

During the hearing, CJP said if one FIR is registered against every prosecutor then they would come to know how people are thrown into trouble. He said awkward actions are being taken and prosecution has become slave of the police and added SHOs and investigation officers are corrupt.

Chief justice police department should be closed as it is joke with the tax payers’ money. He said they appear in front of us while actual thing is what they have investigated. He said that Supreme Court will run logically and added everything has to be repeated for three times in front of lawyers.

During the hearing Justice Aminuddin Khan remarked while addressing petitioner’s lawyer that he should read the last order of October 26, 2023 of the Supreme Court. To this the Chief Justice remarked they would not listen to this but will start making speech. Actually we run proceedings in the light of written things so do not make speech. You should learn as to how to answer a question. If the lawyers intend to become witness they can do so.

The lawyer argued that his client hired as manager to a person whom he had rented out a shop while there is allegation of stealing different things on the accused. To this chief justice of Pakistan asked what was the name of those items. Upon this, additional prosecutor general Punjab said names of those things have not been mentioned.

Chief justice questioned whether the FIR was registered for the sake of minting money. He further ordered police to not arrest anyone on mere allegations leveled in FIR until and unless it has incriminating material. The court prorogued the hearing of the case for an indefinite period. The court has sought the answers of the questions from the additional prosecutor general Punjab on the next hearing of the case. The court also directed the brother of the deceased present in the court, Amjad Iqbal to hire the counsel or should argue the case himself.
