SC turns down bail after arrest petition in a narcotics recovery case

ISLAMABAD, Oct 10 (SABAH): Supreme Court of Pakistan (SCP) in narcotics recovery case has turned down the bail after arrest application of the accused.

A two-member bench headed by the senior most judge of the Supreme Court Justice Sardar Tariq Masood and comprising Justice Ms Musarrat Hilali conducted hearing of the case pertaining to recovery of two kilograms marijuana. The petition was filed by an applicant Noorgah Jan against the verdict of the Peshawar High Court (PHC). In the application, the State was made party through the Advocate General Khyber Pakhtunkhwa.

During the course of hearing, additional advocate general Khyber Pakhtunkhwa appeared before the bench along with the police officials while from the accused side Ejaz Ahmed Advocate appeared from Peshawar Supreme Court Registry through the video link.

During the hearing, Justice Sardar Tariq Masood remarked that at the Supreme Court’s level it has to be seen that whether recovery has been made or not. He said if the accused was driving vehicle without license, then he had to be fined as narcotics has been recovered from the vehicle and the accused has been arrested from the site of incident.

Justice Sardar Tariq Masood further remarked that risk involves in such matters. He further said that the Mehran car bearing number 882552 has been registered in Islamabad. The court while rejecting the appeal dismissed the petition after hearing the arguments.
