USA-India joint statement about Occupied Kashmir is clear violation of UNSC resolutions: Analysts

ISLAMABAD, June 26 (SABAH): Law experts and analysts of international affairs have made it clear that USA-India joint statement about Occupied Kashmir is clear violation of United Nations Security Council’s (UNSC) resolutions while putting aside opinion of an institution of United Nations about the issue. 

They were of the view that the US role of assisting Indian imperialism will create an imbalance in South Asia that may put the region at the way of atomic confrontation and continued that during the Prime Minister of India Narrendra Modi’s visit to the US, the joint statement of Modi-Biden plainly targeted the just struggle of Kashmiris of Indian-held Jammu and Kashmir.  

“According to the Article 21 (1) of Universal Declaration of Human Rights Everyone has the right to take part in the government of his country, directly or through freely chosen representatives. (2) Everyone has the right of equal access to public service in his country. (3) The will of the people shall be the basis of the authority of government; this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures,” they argued. They added in the light of this article people of each and every region have right to choose their rulers. 

The analysts further commented that it is permanent constitutional obligation of the United Nations to take visible steps in helping out the Kashmiris in their justified movement of self-determination as it played its constitutional role in East Timor in 2002 and South Sudan in 2011. They added that the US also helped out Irish Republic Army (IRA) and in 1990, they even provided arms to the fighter of Irish while such action was impossible sans the will of the government of the US. 

They that the aforementioned movement had a political and moral support of the US rulers and added it (US) played an important role in implementing the United Nations resolutions about the major population of Catholic Christians regarding East Timor. On the same lines, the US should play its part for the freedom of Kashmiris, they argued. 

“Which destroyed Iraq on the basis of false and fabricated allegations of spreading fatal weapons? Former prime minister of British Tony Blair himself admitted that falsehood was forged to attack Iraq. If International Court of Justice is still alive then it should take action against the US, British and other countries which played havoc in Iraq. All the nations except Kashmiris benefit from the UN while international institutions remained tightlipped when it is about Muslims,” they deplored. 

Hizbul Mujahideen chief and Muttahida Jihad Council Chairman Syed Salahuddin while strongly condemning Modi-Biden’s joint statement stressed upon Biden administration to consider ground realities with respect to solution of Occupied Kashmir issue in the light of United Nations resolutions as well as aspirations of Kashmiri people. 

He stressed upon the Biden administration to play its part in resolution of Kashmir dispute while considering the ground realities as biased and prejudice-based approach will dent international image of the United States of America as well as it was happening.

He maintained that Hizbul Mujahideen has never been involved in illegal activities and added this organization always faced the occupied forces which was totally in accordance with the manifesto of United Nations. He stressed upon the Biden administration to play its due role in resolving the Kashmir dispute.

Director Foreign Affairs of Jamaat-e-Islami Pakistan, Asif Luqman Qazi commented that the joint statement issued by United States and India ignores the human rights violations by Indian ruling party.

He said it also ignores the violation of UN resolutions by Indian government by revoking constitutional articles that gave special status to the State of Jummu and Kashmir. He furthered that BJP members are involved in communal violence against Muslims and other religious minorities in India. Attacks on Muslims, incidents of lynching, and barring Muslims from performing religious obligations have increased since Prime Minister Modi came to power. 

“Similarly, there is an attempt to merge the State of Jammu and Kashmir in complete disregard of UN resolutions on Kashmir. The United States being an important member of the UN Security Council, has a moral obligation to support the right of self-determination of the Kashmiri people,” he argued.

“The Indian government and armed forces are involved in terrorist operations inside Kashmir. Millions of Kashmiris are living under siege and face violent oppression by Indian armed forces on a daily basis. How can US government ignore all these human rights violations and accuse Pakistan of cross-border terrorism instead? Kashmiris have the right to resistance under UN Charter that Indian government has so blatantly violated. How can US government justify its support to Ukraine in its conflict with Russia if it terms the Kashmiri resistance as terrorism?” he questioned

He maintained that Kashmir is a disputed territory according to UN resolutions and the UN charter gives Kashmiris the right to resistance against Indian occupation. He said that United States should call upon India to respect UN resolutions and give Kashmiris their inherent right of self-determination. “India has no legal right to unilaterally declare the State of Jammu and Kashmir as its integral part. Kashmiris will never accept themselves as Indians, and will always resist the occupation forces to achieve their freedom. US government has the right to enter into bilateral agreements with India for its economic interests, but it has no right to condone the occupation of Kashmir and deprive Kashmiris of their rights,” he added.
